Welcome to Orthodate. This document establishes a contractual agreement between you and Orthodate (669 611 572), outlining the terms and conditions that govern our relationship.
Agreeing to our Terms of Use
When you create an Orthodate account, you are agreeing to familiarise yourself and comply with Orthodate’s Terms of Use, Privacy Policy, Cookie Policy, and Community Guidelines. (https://www.orthodate.com.au) These documents are all part of, and together form, the entire agreement between you and Orthodate. If you are not willing to accept all of the terms of this agreement, please refrain from using this service.The particulars of the Orthodate agreement are subject to change over time, due to reasons such as changes to law, implementation of new features, or changes in business practices. The latest version of the agreement will be available in Orthodate's settings, and you should review it regularly to stay up to date. The updated version of the agreement is the one that applies, and if you continue to use the service after any changes have been made, you are accepting the new version.Orthodate’s primary purpose is to provide Orthodox Christians in Australia with an online platform where they can easily meet other members of the Australian Orthodox denomination, and potentially create lasting and meaningful relationships via these connections. Consistent with this purpose, Orthodate’s organisational values are founded on Christian values derived from the Christian faith and religious practices.Orthodate certainly welcomes everyone to our platform, but we expect users to respect our organisational values, and to exercise caution when expressing personal views relating to Christianity or the Orthodox religion, particularly where those views may be inconsistent with Orthodate’s above-mentioned values. Orthodate reserves the right to terminate a user’s account, in the event that content or commentary uploaded to our platform by that user is deemed inappropriate or offensive by Orthodate moderators.Please Note: By using Orthodate, you acknowledge that we may collect and use your data and information in accordance with our Privacy Policy. Eligibility
In order to create an account or use Orthodate, you must meet the following eligibility criteria:- you are at least 18 years old
- you are able to enter into a legally binding agreement with Orthodate
- you are not prohibited by law from using this service in Australia or any other jurisdiction
- you agree to comply with the terms of this agreement
- you have never been convicted of a sex crime or a violent crime, nor are you required to register as a sex offender with any State or Federal sex offender registry.
Account Security
You are accountable for keeping your login credentials secure, and for their use to register and log in to Orthodate. You are solely responsible for any actions taken on your account. If you suspect that someone has gained unauthorised access to your account, please contact us (https://www.orthodate.com.au) without delay and report any concerns.
Termination/Deletion
You have the option to end your account at any time, and for any reason, by following the instructions provided in the "Settings" section of the Orthodate app. However, if you have used a third party payment account, such as Apple's App Store or Google Play Store, you must manage in-app purchases via those accounts, to avoid being charged after deleting your account. It is important to note that removing an app does not deactivate your account. To deactivate your account, please utilise the relevant functionality provided by the service. To terminate your account at any time, please utilise the available functionality directly within Orthodate.Orthodate reserves the right to terminate your account without prior notice if it suspects that you have violated the terms of this agreement. If your account is terminated, you will not be entitled to any refund. Once your account has been terminated, this agreement will come to an end._Please note: Orthodate moderators will review account content on an ongoing basis to ensure that no information is uploaded that breaches our Terms of Use, Privacy Policy or Community Guidelines. Where moderators deem user content inappropriate or offensive, Orthodate reserves the right to restrict or terminate any account.
Safety
At Orthodate, we strive to promote a respectful member experience by implementing features such as the double opt-in, which allows members to communicate only after expressing mutual interest in each other. However, we cannot be held responsible for the behaviour of any member, whether on or away from the service. It is important to exercise caution when interacting with other members, particularly if you choose to communicate outside of the service or arrange in-person meetings. You agree not to share your financial information, such as credit card details, or send money to other members of Orthodate.It is solely your responsibility to manage your interactions with other members. Please note that Orthodate does not perform criminal background checks on its members or investigate their backgrounds in any other way. As such, Orthodate makes no representations or guarantees regarding the conduct or compatibility of its members.Please refer to our Safety Tips (https://www.orthodate.com.au/safety-tips) for further guidance.
Community Standards
By using Orthodate, you agree that you will not engage in any of the following prohibited activities:- use Orthodate for any illegal or harmful purpose, or undertake any actions that violate this agreement
- use Orthodate with the intention to damage Orthodate
- violate our Community Guidelines or undertake any actions that interfere with Orthodate’s operating policies and procedures
- attempt to spam, solicit money or defraud any members
- attempt to promote any content of a commercial nature, or upload links to other websites
- attempt to impersonate any person(s) or entity or post any images of another person(s) without his or her permission,
- attempt to bully, stalk, intimidate, assault, harass, or mistreat any person
- post any content that violates or infringes on anyone’s rights
- post any content that contains hate speech, is threatening, sexually explicit, harmful to minors, or pornographic
- post any content that incites violence, or contains nudity or violence
- post any content that promotes racism or hatred against any group or individual, or is defamatory in nature
- attempt to solicit passwords or personal identifying information from other Orthodate members
- share your account with another Orthodate member or create multiple accounts
- register another account if your previous account has been terminated, unless you have permission from Orthodate
- post any content that offends the Orthodate community.If you violate any of these terms, Orthodate reserves the right to terminate your account without a refund.
Other Members’ Content
Orthodate retains the right to review and remove any content that violates this agreement. However, the member who posts such content will be solely responsible for it, and Orthodate cannot ensure that all content meets the requirements of this agreement. If you come across content on Orthodate that violates this agreement, please report it to us immediately. (Terms Of Use)You have no rights concerning other users' member content, and you can only use their personal information in line with Orthodate’s purpose of facilitating connections. Using other users' information for commercial purposes is prohibited. Misusing other users’ information may result in the termination of your account, at our discretion.
Your Content
When you upload your content on Orthodate, you confirm that you have the necessary rights and permissions to do so. You also grant us a non-exclusive, royalty-free, worldwide license to use your content in various ways, such as editing, copying, modifying, distributing, and making it available to the public. This license extends to all formats and mediums, both current and future.
Transactions
Orthodate may provide in-app purchases through the Appstore, Google Play Store, or other authorised third party payment platforms. If you decide to make an in-app purchase, you will be asked to confirm the purchase with the selected payment provider, and the payment method you provided will be charged for the service(s) you have selected, including any applicable taxes. By making the purchase, you authorise Orthodate or the third-party account to charge you.Updating payment detailsYou can update your payment information via the Orthodate settings. If a payment fails due to reasons such as an expired card or insufficient funds, and you don't subsequently update your payment details to facilitate payment, or cancel your subscription, you are responsible for any outstanding amounts owed to Orthodate. By authorising us, we may continue billing your updated payment method, potentially resulting in changes to your billing dates. Additionally, you give us permission to obtain updated card information from your card issuer.Subscription auto-renewalYour chosen payment method will be automatically charged until you choose to cancel the subscription. The subscription will continue to renew at the agreed price unless you cancel prior to the renewal date. You can be confident that your payment information will be securely stored and utilised for automatic payments as per these agreed terms.If you have any billing inquiries or objections, please contact us (https://www.orthodate.com.au/) or your relevant bank/payment provider. Deleting your Orthodate profile or removing the application from your device will not stop you from being billed. To cancel the subscription, you must cancel it via the Appstore or Google Play Store.Billing errorsIf you choose to make direct payments to Orthodate, please note that Orthodate has the authority to review and amend any billing errors, irrespective of whether payment has been requested or received. However, it is important to be aware that if you initiate a chargeback or reverse a payment made through your Payment Method, Orthodate holds the discretion to promptly terminate your account.
Refunds
No refunds or credits are available for any purchases made, including partially used periods. If you made a purchase using your Apple ID, refunds are handled by Apple. To request a refund, please contact Apple directly. Similarly, if you made a purchase using the Google Play Store, you can request a refund by contacting Google directly. If you made a purchase through a payment platform not listed above, please request a refund from that third party provider.
Copyright infringement
If you suspect that your personal or creative work has been copied and published on Orthodate in a manner that infringes on your copyright, you can alert us by submitting a ‘Request for content removal’ form (https://www.orthodate.com.au). When submitting the form, please include the following details:- an electronic or physical signature of an authorised person representing the copyright owner who alleges that their exclusive rights have been violated
- identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are included, a representative list of such works
- identification of the infringing material that needs to be removed or access to which should be disabled, along with sufficient information to enable the service provider to locate the material
- contact information, such as an email address, physical address, or phone number, that would allow the service provider to contact you
- a true statement that you believe, in good faith, that the use of the material in the manner complained of is not authorised by the copyright owner, their agent, or the law.
- a true statement, that the information contained in the notification is accurate and that you are authorised to act on behalf of the owner of the exclusive right allegedly infringed.Orthodate will terminate accounts of repeat infringers.
Disclaimers
Orthodate makes every effort to ensure that the service is available as much as possible, but we offer the service on an "as is" and "as available" basis. Orthodate does not provide any warranties (either express or implied), including warranties of satisfactory quality, with respect to the service. We do not guarantee that the service will be uninterrupted, faultless, or safe, or that any content or information you obtain through the service will be accurate.Please note that Orthodate is not responsible for any content that you or another member send or receive through the service. You agree to access and download any material via the service in accordance with your own judgment.You are responsible for ensuring that any material you obtain from Orthodate is free from viruses or harmful components. Orthodate is not liable for any damage to your computer hardware, computer software, or any other equipment or device used to access Orthodate.
Indemnity
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Orthodate and its employees from and against any and all complaints, expenses, losses, damages, costs, liabilities, claims, and demands, including legal fees, arising from your access to our service, your contact with others through our service, or your breach of this agreement.In connection with the Orthodate app, you are not required to indemnify Orthodate for any material fact omission, suppression, misrepresentation, false promise, deception, or fraud. The foregoing provision does not apply to unconscionable commercial practices.
Entire Agreement
The entire agreement between you and Orthodate, comprised of Orthodate’s Terms of Use, Privacy Policy, Cookie Policy, and Community Guidelines, constitutes the complete and exclusive agreement between you and Orthodate regarding the use of our service. You acknowledge that your Orthodate account is non-transferable, and your rights to your account and its content cease upon your death. This agreement does not create any agency, partnership, or other special relationship, and you are not authorised to make any representations on behalf of, or bind Orthodate, in any way.
Dispute Resolution
For inquiries, feedback, or complaints related to the management of your personal information in Australia or potential breaches of Australian privacy laws, please contact the Privacy Officer for Australia using the contact details for the Office of the Australian Information Commissioner provided below.If you wish to file a complaint regarding our adherence to privacy regulations, including the Privacy Act or the Credit Reporting Privacy Code, please contact us (https://www.orthodate.com.au/). We will acknowledge your complaint in writing within seven days and proceed to investigate by consulting relevant third parties, such as credit reporting agencies or other credit providers, if necessary. Our decision, along with the reasons behind it, will be communicated to you within 30 days from the date of your complaint (unless you have agreed to a longer time frame in writing).If our decision does not meet your satisfaction, you have the option to escalate your complaint by contacting the Office of the Australian Information Commissioner by phone at 1300 363 992, or via email at enquiries@oaic.gov.au.
